Regulations for Motor Vehicles in Yanlord Garden
------ For the purpose of Suggestion Inquiry
The regulations have inquired from Dec12~Feb 28 and approved by owner committee on March 10. The regulations will be implemented from May 1,2007.
Management of Transportation in Yanlord Garden, the goals are:
to create a safe and well-organized living environment
to ensure the legal interest of the whole community owners
to audited the process and to enforce all vehicles in abiding by the rules
to identify parking-lot owners or lessee of the underground parking lot spaces
to identify temporary vehicles and control their entrance and exit
to comply with REGULATION No. 33<<Management Law of Urban Newly-built Compound> >、<<Regulations of Property Management>> from Construction Department of PRC for the whole Community
1. Regulations for Vehicle Movement
a. All vehicles are required to drive only on approved roads or lanes. This applies to all Parking-lot Owners, Lessee of the Parking Lot, and Vehicles with temporary entry permits to the compound. Special Purposes vehicles, i.e. fire trucks, police and other emergency type vehicles are excluded. All visitors and their vehicles are required to be registered and confirmed by the Guard on duty prior to entry.
b. The enterprise in charge of Property Management shall regulate the entrance and exit of all vehicles. This includes collection of any and all fees for parking lot owners, parking lot lessee and temporary vehicle permits. Personal property and belongings in all vehicles are the sole responsibility of the vehicle owner.
c. All vehicle operators are required to obey all signs posted in the compound. The vehicle operator is responsible for and bears the cost of repair for damage caused to the Public Area from either negligence or willful behavior.
d. Parking spaces and locations have been designed for different vehicles Length & Width requirements. Over sized vehicles can only park in the special designated areas.
e. A One-Way Drive rule is applied in the Compound from 7:00-9:30 and obvious signs are posted. This rule is to provide a safer environment for the people of the community, not the vehicles.
f. All vehicles in the compound are not allowed to park along the Road of the Compound. All vehicles shall be parked in the underground parking facility, in their approved or assigned space. Vehicles with specialized purpose and conducting official business or work from Police Station, Fire-Emergency, Ambulance, First-aid and Environment-Protection as well as the Vehicles for Moving Purpose are excluded.
g. Temporary Parking Lot for Super-Long or Super-High Vehicles must park East of Block 20-21 Phase I. The Vehicles can be parked temporarily after being registered.
h. The speed limited in the compound is 5 KPH. The speed limited in the underground parking facility is 5 KPH. Vehicles shall have their headlights on at all times while moving in the underground parking facility. Operation of a vehicle’s horn is not permitted, except for safety notification reasons.
i. No vehicle can be cleaned or maintained on the road of the compound or in the underground parking facility. A professional Car-Cleaning business has been established and approved for vehicle cleaning. The facilities for Fire-Emergency and Public Water Pipes in the compound and the underground parking facility cannot be used for personal use or other purposes.
2. Regulations for Temporary Parking of Vehicles
a. There is a parking facility based underneath in the compound. All vehicles in the compound and in the underground parking facility shall only park in the approved visitor’s parking spaces area. No visitor vehicles are allowed to park in any other parking space or area. Temporary Parking for 2 hours in the compound is free of charge, The Fees after 2 hours shall be charged according to <<Criterion for Fees of temporary parking in Yanlord Garden>>, which is RMB8 per hour per vehicle.
b. The Vehicle shall be parked inside the appointed parking space. It cannot be parked on or out of the parking space line.
c. Facilities and Attachment of the underground parking facility cannot be damaged. The owner of the temporary parked vehicle is responsible for all repairs and costs.
d. The “Plate for Parking Allowance” shall be placed in the Right-hand corner of the Windshield glass. This allows Staff from the Compound to survey and manage parked vehicles easily.
e. The parking card should be placed in the right corner of windshield or observable position.
3. Violation of the Regulation
a. In order to protect the legal interest of compound’s owners, the Property Management Office will use the method of TEMPORARY LOCKING THE VEHCLE, and may include hiring a professional outside company to tow-away a vehicle. The authorization of enforcement from of the Owner Committee is targeted to the vehicles and operators (users) who do not abide by the << Regulations for Motor Vehicles in Yanlord Garden>>. The Cost of Parking, locking and towing shall be the responsibility of the Default Party. (Annotation: The Fees for Parking will be charged twice as the normal criterion—RMB16 per hour per vehicle beginning with first hour, the 2-hour free charge will not be allowed.) The Property Management Office reserves all rights to tow the Vehicle in case the parking-period is more than 2 hours. The tow-away fee shall be charged by the professional company at the price of RMB300 per vehicle for each towed vehicle. In case the vehicle operator insists on not paying the correspondent fee, the property Management is authorized by the Owner’s Committee to stop the default user from any further parking privileges and temporarily retain or keep the vehicle until the default user pays all fees. Furthermore the Management Office holds the right for the legal liability.
b. The vehicle operator, legal vehicle owner or parking-lot user shall be responsible for all willful or un-willful damage to the Underground Parking Facility, Road, Greenery and other Facilities of the Public Area. The Owner’s Committee or the authorized Management Company of the compound is entitled to request compensation from the default party for the loss as well as the legal liability.
c. The occupation of someone else’s assigned parking space is not allowed. Notify the Vehicle-Management staff immediately if another vehicle has been wrongly parked. The staff will advise the vehicle operator or owner to remove the vehicle at once. The default party shall be responsible for all negligence or damage and according to the regulations will be responsible fees and compensation for any or all repairs.
d. For the Vehicle-owner who often violates the regulations or does not cooperate with the Staff of Vehicle-Management of the compound, shall be deemed as being un-cooperative for the betterment of the community. The Management Company is entitled to publish the Plate Number of the violating vehicle as well as the Name of the vehicle-owner as a Warning.
The Right of Explanation belongs to Owner Committee of Yanlord Garden and Management Office Center of Yanlord Garden.
The regulations will be implemented from May 1, 2007.
